THIS PROMOTION IS INTENDED FOR PLAY IN THE UNITED STATES ONLY (EXCLUDING PUERTO RICO) AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. By entering the Top-Flite Newsletter Promotion -- Win a Year's Supply of Top-Flite D2 Feel Golf Balls ("Promotion"), each entrant agrees to abide by these Official Rules.
HOW TO ENTER: During the Promotion Period, visit www.TopFlite.com and register to receive a complimentary subscription to the Top-Flite e-newsletter ("Newsletter") and receive automatic entry into a random monthly drawing for a one year's supply of Top-Flite D2 Feel golf balls. Limit of one (1) entry per household; each entrant may win only once.
Participants must provide first and last name and a valid email address on the Newsletter registration form. Upon completion of the form, click the "submit" button to complete registration and begin receiving the complimentary Newsletter, as well as automatic entry into the random monthly drawing. Entries must be received by noon (Pacific Time) on September 30, 2008. All entries are subject to Callaway Golf's Privacy Policy at www.callawaygolf.com/en.cg.PrivacyPolicy.html. Use of multiple email addresses will void entry. Post Office Box addresses will not be accepted. More than one (1) entry per household will void all entries for said household. No automatic, programmed, robotic or similar means of entry are permitted and individuals engaging in such practices will be disqualified. In the event of a dispute regarding the identity of the person submitting an online entry, the entry will be deemed submitted by the person in whose name the email account is registered, provided that person meets all eligibility criteria set forth in these Official Rules. All entries become the sole property of Callaway Golf and will not be acknowledged or returned.
ELIGIBILITY: The Promotion is open only to legal residents of the 50 United States (excluding Puerto Rico) and District of Columbia who are 18 years of age or older at time of entry. Proof of age and residency may be required. Offer not valid for groups, clubs, or organizations, employees of Callaway Golf Sales Company and its subsidiaries, affiliates, parent companies, retail locations, suppliers, distributors, advertising, promotion or any other agencies or entities involved with this Promotion and members of their families (parents, siblings, children, and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above. Void outside the United States and where prohibited. Promotion also void where restricted in a manner not satisfied by the publication of these terms and conditions on this website. No purchase necessary nor shall a purchase increase odds of winning.
DRAWING: One winner will be selected on each of the following dates: February 28, March 31, April 30, May 31, June 30, July 31, August 29, and September 30, 2009, in a random drawing from all eligible entries received to the date of the drawing. Drawing will be conducted by Callaway Golf, whose decisions will be final and binding in all respects. Actual odds of winning depend upon the total number of eligible entries received. Estimated odds of winning are 1:400, but will be subject to the final number of entries.
PRIZE: Upon certification by Callaway Golf as an eligible participant, the winner will receive a one-year supply of Top-Flite D2 Feel golf balls (12 15-ball packs of golf balls) with a retail value of $192.00 (the "Prize"). No substitution of the Prize or transfer of the Prize to a third party is permitted, except by Callaway Golf, who may substitute a prize of equal or greater value.
Taxes and duties (where applicable) are the sole responsibility of the winner. All expenses not specified herein, including, but not limited to local, state, or federal taxes on the Prize, are the sole responsibility of the winner. Entry in this Promotion constitutes each entrant's agreement to pay all applicable taxes and comply with all laws.
NOTIFICATION AND COLLECTION OF PRIZE: The potential winner will be notified by email within five (5) days of each drawing. The potential winner is subject to verification and must meet all eligibility requirements before the Prize will be awarded. In the event that the potential winner does not meet all eligibility requirements, that person may be disqualified and the Prize will be awarded to another randomly selected individual. The potential winner must follow the directions contained in the Prize Acceptance Form provided by Callaway Golf and email or fax all completed forms, correctly filled out and signed, and provide any additional information that may be required, to Callaway Golf within three (3) days of notification as a potential winner, including, but not limited to, an Affidavit of Eligibility/Further Release of Liability and Publicity Rights (where legal). Failure to respond within the time specified or other non-compliance with these Official Rules will result in disqualification as a potential prizewinner and void further participation in the Promotion. If a selected entrant cannot be contacted in a timely fashion, or if for any reason a Prize cannot be awarded, another promotion entry will be randomly selected until the Prize has been awarded. Callaway Golf is not responsible for any failure for any reason whatsoever of the selected entrant to receive notification or for Callaway Golf to receive a selected entrant's response.
GENERAL TERMS AND CONDITIONS: To the fullest extent allowed by law, by accepting the Prize, the winner consents to the use of his/her name and address and/or likeness for purposes of advertising or trade without additional compensation. By entering the Promotion, all entrants consent to Callaway Golf's collection, use and disclosure of personal information to any third party for the purposes of administering the Promotion and, unless otherwise specified, for consumer research and marketing purposes. To the extent permitted by law, upon entering into this Promotion, each entrant agrees to Callaway Golf's use of his/her personal information, as described in its Privacy Policy located at: www.callawaygolf.com/en.cg.PrivacyPolicy.html and its Legal Statement located at www.callawaygolf.com/en.cg.PrivacyPolicy.LegalStatement.
By accepting the Prize, the winner releases Callaway Golf Sales Company, its subsidiaries, parents and affiliates, its advertising, judging and promotion agencies, and the respective shareholders, directors, officers, distributors, employees and agencies of all such entities, from all liability arising from or in connection with the acceptance, possession, or use/misuse of the Prize. The winner acknowledges that neither Callaway Golf nor its agents have made or are in any manner responsible or liable for any representation, guarantee or warranty, expressed or implied, in fact or in law, relative to any Prize awarded herein, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose.
Callaway Golf assumes no responsibility for computer system, hardware, software, or program malfunctions or other errors, failures, delayed computer transmissions or faulty network connections, whether human or technical in nature. Callaway Golf is not responsible for late, incorrect, lost, illegible, incomplete, stolen, damaged, misdirected entries or Prize claims. If, in Callaway Golf's opinion, there is any suspected or actual evidence of tampering with any portion of the Promotion, or if technical difficulties compromise any portion of the Promotion or the integrity of the promotion, Callaway Golf reserves the right to suspend, modify or terminate the Promotion and conduct drawings to award the Prizes using all legitimate and eligible entries received as of the date of action taken by Callaway Golf.
This Promotion is governed by the laws of the State of California for the resolution of all claims and disputes.
